Contesting Information

You have the right to appeal this administrative citation at a hearing before an administrative hearing officer. To request a hearing, you must complete a “Request for Hearing” form and return it to the CITY OF WEST COVINA C/O ADMIN CITATION PROCESSING CENTER, P.O. BOX 3926, TUSTIN, CA 92781-3926 WITHIN TWENTY ONE (21) DAYS of the issuance date of the administrative citation. The Request for Hearing should be accompanied by an advanced deposit of the fine or request for a Hardship Fee Mitigation Form when you are not able to pay for the citation and submit all proof of income and expenses, pursuant to Section 15-226(e) of the West Covina Municipal Code.

You will be notified of the time and place of the hearing at least ten (10) days before the date of hearing. If the hearing officer determines that the administrative citation should be cancelled, the deposit shall be returned to you. Failure to appear at the hearing will result in forfeiture of your deposit and will be deemed a waiver of your right to an administrative hearing.

Payment of the fine must be made within thirty (30) days of issuance date of the citation. Payments made after 30 days of issuance date are subject to a late fee. Make your check or money order payable to: CITY OF WEST COVINA. DO NOT SEND CASH. To ensure proper credit, please write the citation number on your check or money order. Penalty and bank charges will be assessed for checks returned by your bank. Mail payment to The City of West Covina, Citation Processing Center, and P.O. Box 3926, Tustin, CA 92781-3926. FAILURE TO TIMELY PAY THIS CITATION MAY RESULT IN FURTHER LEGAL PROCEEDINGS AND A TAX LIEN AGAINST YOU AND/OR AGAINST YOUR PROPERTY FOR PENALTIES, AND THE COSTS OF ENFORCEMENT AND COLLECTION.

Any person who is financially unable to pay the administrative fine may file a request for a hardship fee mitigation form with the City within the time set and at the same time as the request for a hearing. The request shall be in writing and shall describe why the fine cannot be paid, any payment schedule, and supporting documents. The request shall be made under penalty of perjury. Once filed, the requirement for payment of an administrative fine shall be stayed while the city manager or his/her designee determines whether to grant the request. His/her determination shall be in writing and served on the responsible party. If the city manager or his/her designee does not waive or establish a payment system, the administrative fine shall be paid within not less than ten (10) working days or later as set out in the notice. FAILURE TO MAKE THE DEPOSIT WITHIN TEN (10) BUSINESS DAYS AFTER DENIAL OF THE WAIVER OR TWENTY-ONE (21) DAYS FROM THE ISSUANCE DATE OF THE ADMINISTRATIVE CITATION, WHICHEVER IS LATER, WILL CONSTITUTE A WAIVER OF YOUR RIGHT TO AN ADMINISTRATIVE HEARING.
